The Cyberspace Administration of China has released for public comment a revision of the Measures on the Administration of Mobile Internet Application Information Services, which took effect in August 2016. The draft bars app providers from inducing downloads through false advertising or bundled installs, or by using illegal and harmful content – and from using bots or people to fake rankings, inflate volume, manipulate reviews and fabricate traffic.
Real-name registration and content governance
Apps offering information publishing or instant messaging must verify registrants’ real identity via mobile phone number, ID number or unified social credit code; users who refuse or register falsely under an organisation’s or another person’s identity must be denied service.
App providers must build sound content review mechanisms – user registration, account management, information review, daily patrols and emergency response – staffed and equipped to match service scale. Users violating laws or service agreements face warnings, feature limits or account closure, with records kept and reported to authorities.
Distribution platforms must establish monitoring and evaluation mechanisms, fight grey-market operations, guard against faked download counts and ratings, and refuse service to apps misusing state imagery or impersonating government bodies, or carrying illegal content, data security risks or improper personal information collection.
Personal information and minors
Personal information processing must follow lawful, legitimate, necessary and good-faith principles with clear reasonable purposes and public rules; providers may not compel consent to non-essential processing, nor deny basic service to users who decline to provide non-essential information.
Data processing requires full-lifecycle data security management, technical safeguards and risk monitoring, without endangering national security, the public interest or lawful rights of individuals and organisations.
App providers must follow the best-interests-of-the-child principle: enforce real-name registration and login for minors, and never offer products or services that induce addiction in minors.
